We affirm the district court's conclusion that it lacked the power to grant appellant's motion for a judicial recommendation against deportation pursuant to 8 U.S.C. Sec. 1251(b)(2). See United States v. Murphey, No. 90-10178 (9th Cir. April 29, 1991).
