MEMORANDUM*
Since appellant neither sought certification from the Bankruptcy Appellate Panel under 28 U.S.C. Sec. 1292(b) nor filed a petition in this court under Fed.R.App.P. 5(a) within ten days after receiving certification, we are without jurisdiction to review the order affirming the denial of summary judgment. Cf. In re Benny, 791 F.2d 712, 718-19 (9th Cir.1986).
DISMISSED.
