ORDER

This matter is before the Court upon the plaintiff's response to the orders to show cause entered on April 27 and 28, 1989. The plaintiff also moves for consolidation of his appeals and for refund of all but one of the filing fees he has paid.

The plaintiff appealed from two opinions and orders of the district court in consolidated actions against his employer and local union. (Case Nos. 89-1429, 89-1455). Neither opinion and order finally resolved either action, nor was a final judgment entered in either action. Accordingly, orders to show cause why the appeals should not be dismissed were entered. The plaintiff responded that on April 24 judgments dismissing both actions were entered by the district court. The plaintiff has filed timely notices of appeal from these judgments, and stated his intent to address in the appeals the earlier nonfinal orders. These appeals have been docketed as 89-1585 and 89-1586. We conclude we have jurisdiction in Case Nos. 89-1585 and 89-1586, and consolidate those cases.

It is therefore ORDERED that the show cause orders are discharged, and the appeals in Case Nos. 89-1429 and 89-1455 are dismissed sua sponte for lack of jurisdiction. Rule 9(b)(1), Local Rules. It is further ORDERED that the appeals in Case Nos. 89-1585 and 89-1586 are hereby consolidated. It is finally ORDERED that the plaintiff's request for a partial refund of filing fees is denied.
